Form DPT-3 – Return of Deposits

Service of Corporate Affairs, vide notice dated 22nd January 2019, distributed the Companies (Acceptance of Deposits) Amendment Rules, 2019. With the said change, the MCA has made it fundamental for all organizations enrolled in India to document Form DPT-3 at the very latest 22nd April 2019.

G.S.R. 42(E).— In exercise of the forces presented by provision (31) of area 2 and segment 73 read with sub-segments (1) and (2) of segment 469 of the Companies Act, 2013 (18 of 2013), the Central Government, in conference with the Reserve Bank of India, therefore makes the accompanying principles further to revise the Companies (Acceptance of Deposits) Rules, 2014, in particular:-

1. (1) These principles might be known as the Companies (Acceptance of Deposits) Amendment Rules, 2019.

(2) They will come into power on the date of their distribution in the Official Gazette.

2. In the Companies (Acceptance of Deposits) Rules, 2014 (hereinafter alluded to as the said principles), in standard 2, in sub-rule (1), in proviso (c), in sub-clause(xviii), after the words "Foundation Investment Trusts," the words "Land Investment Trusts" will be embedded.

3. In the said principles, in guideline 16, the accompanying Explanation will be embedded, to be specific:- "Clarification.- It is, therefore, explained that Form DPT-3 will be utilized for recording return of store or points of interest of exchange not considered as a store or both by each organization other than Government organization.".

4. In the said standards, in principle 16(A), after sub-rule (2), the accompanying sub-rule will be embedded, to be specific:- "

(3) Every organization other than Government organization will document a onetime return of exceptional receipt of cash or credit by an organization yet not considered as stores, as far as proviso (c) of sub-rule 1 of principle 2 from Tandoor Manufacturer the 01st April, 2014 to the date of production of this notice in the Official Gazette, as indicated in Form DPT-3 inside ninety days from the date of said distribution of this notice alongside expense as gave in the Companies (Registration Offices and Fees) Rules, 2014.".

The pertinence of Return of Deposits 

Structure DPT-3 recording must be made by all organizations other than a Govcompany company. Subsequently, all private restricted organization, OPC, constrained organization or Section 8 Company would be required to record Form DPT-3.

DPT-3 Due Date 

The Companies (Acceptance of Deposits) Amendment Rules, 2019 has referenced that all organizations would be required to record Form DPT-3 one-time prior to the 22nd of April 2019. In the arrival, the organization must give subtleties of exceptional receipt of cash or credit by an organization however not considered as stores from first April 2014 up to 22nd January 2019.
